Government Extends Deadline For Tax Settlement Scheme

Government Extends Deadline For Tax Settlement Scheme
The Direct Tax Dispute Resolution Scheme seeks
not just to settle disputes in retrospective taxes, but
end nearly 2.6 lakh pending tax cases where Rs. 5.16 lakh crore are locked in.

The Direct Tax Dispute Resolution Scheme was introduced on June 1.
New Delhi: Giving companies like Vodafone and Cairn Energy one more month to accept its offer to settle retro tax disputes, the government has extended till January 31 its one-time tax dispute resolution scheme.

The Direct Tax Dispute Resolution Scheme, announced by Finance Minister Arun Jaitley in the budget for 2016-17, seeks not just to settle disputes in retrospective taxes, but end nearly 2.6 lakh pending tax cases where Rs. 5.16 lakh crore are locked in.

The offer to settle the disputes was to end on December 31, but it has now been extended till January 31, said the Central Board of Direct Taxes (CBDT).

On May 26, the government had notified the scheme saying it would open on June 1 and close on December 31.

-------------------
"In the said notification, the figures, letters and words December 31, 2016, the figures, letters and words January 31, 2017, shall be substituted," CBDT said in a notification.

The scheme provides for waiving interest and penalties if the principal amount involved in retrospective tax cases is paid.

For disputes other than the retrospective tax cases, taxpayers, whose appeal is pending as on February 29, 2016 before the CIT (Appeals), can settle cases by paying the disputed tax and interest up to the date of assessment.

For a disputed tax amount of up to Rs. 10 lakh, the penalty will be forgone. In cases where the disputed tax amount is above Rs. 10 lakh, a penalty of 25 per cent will be levied.

For penalty appeals, the scheme allows the assessee to pay only 25 per cent of the penalty.

Through the scheme, the government hopes to settle major retrospective tax cases facing Vodafone Group and Cairn Energy of UK. It also expects a third of the other tax disputes to be settled.

The notification comes against the backdrop of tepid response from companies to the scheme. So far, none of the companies facing the retrospective tax cases have come forward.

The scheme provided for waiver of the interest and penalty for retro tax cases only if the company in question withdraws all appeals against the government at all judicial forums.

The tax department had last week come out with the second FAQ on the scheme clarifying that the taxes cannot be paid in instalments.

It had also said companies like Vodafone and Cairn Energy facing retrospective tax demand will have to withdraw legal cases and give up the right to contest constitutional validity of back-dated amendment to I-T laws if they want to avail of the dispute resolution scheme.

"It is, hence, clear that if the assessee avails (of) the scheme, he cannot contest the constitutional validity of retrospective amendment in the high court or the Supreme Court," the CBDT's Frequently Asked Questions (FAQs) said.

A firm availing of the scheme will have to pay the principal tax amount within 30 days to the designated authority determining the amount payable by the declarant.

Don’t hold your breath for a Galaxy S8 with 8GB of RAM

Don’t hold your breath for a Galaxy S8 with 8GB of RAM

We’re nearing January, which means the 2017 launch rumors for new smartphones are starting to ramp up. The biggest device on the way is undoubtedly the Samsung Galaxy S8.
It’s particularly notable because it’ll be Samsung’s first impression after the Galaxy Note 7 debacle, and we know they’ll want to wow the world with it. And considering 2016 was a year of refinement for the company, we’d expect some neat innovations to be included for their 2017 efforts.

One of the early rumors so far is that the device will have 8GB of RAM, alongside word that Samsung will introduce a UFS 2.1 module for more efficient storage performance.
But before we jump with joy, it’s important to take a step back and consider the plausibility of such a rumor. For starters, while many pre-launch rumors regarding Galaxy smartphones tend to be accurate, there are just as many which turn out to be false.
Case in point: the Samsung Galaxy Note 7 having 6GB of RAM. This was an interesting case because there actually was a 6GB model in tow, however Samsung only ever had plans to launch it in China to compete with the country’s manufacturers’ ongoing fascination with ridiculous RAM capacity. Then they decided to scrap those plans for some odd reason (which we now know might have been due to impending plans to end production on all variants of the device).

Elsewhere, they don’t feel the need to do that. The Samsung Galaxy S7 and Galaxy Note 7 (before its untimely demise) were both doing well enough with 4GB of RAM. Why? Because the phones work great at that point and they felt there’s little need to go beyond that.
That’s not to say things couldn’t change with the Samsung Galaxy S8, though. If it’s a question of cost efficiency, 6GB RAM modules should only be getting cheaper from here on out and Samsung may opt to use those “just because.” But where does the benefit of 8GB come from? It’ll likely be more expensive, and thanks to the way Android handles memory management, would probably translate to marginal returns on investment.
Of course, without knowing the price of 8GB modules or why Samsung opted not to go with 6GB in their 2016 phones or any other bits of information that could help us determine their plans, the points are all moot. We’re keeping our fingers crossed for 8GB of RAM in the Samsung Galaxy S8, but we wouldn’t bet on it (nor would we necessarily be mad if it doesn’t pan out).

Trai asks Jio to explain why new offer not violation of norms

Trai asks Jio to explain why new offer not violation of norms

Telecom regulator Trai has asked Reliance Jio to explain why extension of its free voice and data plan should not be seen as violation of existing regulations requiring promotional offers to be limited to 90 days.
Trai shot off the letter after the Mukesh Ambani-led firm announced free data and voice calls for existing and new customers under the 'Happy New Year offer', days before the 90-day inaugural welcome plan ended on December 3.
In the December 20 letter, the regulator, which is in the process of examining the new plan by Reliance Jio, also asked why the offer of free data under the promotional scheme should not be treated as "predatory".
When contacted, Reliance Jio Infocomm Ltd (RJIL) did not offer any comments on the issue. Sources with direct knowledge of the development said the regulator in its letter had cited RJIL's consumer base growing to 63 million as on December 18 to state that the company will become a significant market player in the broadband space shortly, may be by December-end.
Stating that the preliminary analysis relies on factors like average subscriber additions per day and free data being offered, Trai is learnt to have asked RJIL to clarify as to "why the offer of free data under the promotional offer should not be treated as predatory."
Another source said that in a meeting with Trai, Jio has said that the latest Happy New Year offer is substantiatively different from the Jio Welcome Offer (that commenced on September 5) as in the initial offer it had provided 4GB of free data per day, and in the new offer the same was capped at 1GB under Fair Usage Policy.
Also, they contend, in the first offer there was no option of renewal or payment after the 4GB limit was exhausted, but in the new offer, one can recharge both data and the promised speed.
In terms of market dominance, Reliance Jio is six per cent of the installations in the country whereas the Competition Commission of India (CCI) norms specify 30 per cent threshold to trigger the `misuse of market dominance' clause.
Sources said, Trai has also asked Jio to give an estimated month-wise projection of the number of subscribers that are expected to be added till March 31, 2017.
Jio has been given five days to clarify on the issues raised by the regulator. Jio first launched an inaugural free voice and data plan beginning September, and earlier this month extended the freebies till March 31, 2017.
On Friday, incumbent operator Bharti Airtel moved telecom dispute tribunal TDSAT against Trai allowing Reliance Jio to continue free promotional offer beyond the stipulated 90 days, charging the regulator of being a "mute spectator" to violations.
In its 25-page petition before the Telecom Disputes Settlement and Appellate Tribunal (TDSAT), India's largest private mobile services operator had asked the quasi-judicial body to direct Trai to ensure that Jio does not provide its free voice and data plan beyond December 3.
Trai said that Reliance Jio, through a letter on December 7, had informed it about another promotional offer -- Happy New Year -- that would be available to new consumers with effect from December 4, 2016 to March 3, 2017 and the benefits of which would be available till March 31, 2017.
Consumers availing the earlier promotional offers too would be migrated to the Happy New Year offer, Trai has observed.
Trai said that free voice calls, unlimited video calling, and free data, and free Jio apps among others, were offered without break under the various promotional offers by RJIL from September 5.
Therefore, Trai said, preliminary examination of the new offer filed with it `prima facie' reveals that except for minor change in the quantum of data being offered in the new offer, it seems to be an extension of the old promotional offer beyond 90 days.
